General terms and conditions for subscription contracts between the subscription purchaser and EROL Medien GmbH
1. Conclusion of the contract
The subscription contract for the regular subscription of the magazines is concluded through the oral or written order of the subscriber and the subsequent confirmation by EROL Medien GmbH. Delivery begins after this confirmation.
2. Subscriber Obligations
As a subscriber, you undertake to receive the magazine regularly during the contract term and to pay the agreed subscription price.
3. Delivery and complaints
The magazine is delivered in the respective month of publication. If you notice any defects in the delivery, we ask you to inform us immediately by telephone or in writing. Unfortunately, we cannot take retroactive claims into account in the event of late complaints. EROL Medien GmbH is only liable for missing or damaged deliveries in the event of intent or gross negligence.
4. Contract duration and termination
Your subscription is initially valid for 12 months and is automatically extended for a further 12 months if you do not cancel in writing at least two months before the end of the subscription. Both you and EROL Medien GmbH have the right to terminate without notice for good cause. Such an important reason exists, for example, in the event of late payment or a serious breach of essential contractual obligations.
5. Late Payment
If you are in arrears with your payment, we may temporarily stop delivering magazines. If the reminder is unsuccessful, we can take further legal steps, such as hiring a debt collection agency. All costs incurred, including reminder and collection costs, are at your expense. We reserve the right to assert further claims. After all claims have been settled, we will continue delivery as quickly as possible.
6. Changes to your information
Please inform us immediately of any changes to your contact details, especially if you move. This is the only way we can ensure that the magazines are delivered to the correct address.
7. Other
If individual provisions of these General Terms and Conditions contradict the legal regulations and are ineffective, the remainder of the contract remains unaffected. Ineffective provisions will be replaced by provisions that come closest to the economic purpose. This regulation also applies to any gaps in the regulations.
8. Place of performance and place of jurisdiction
The place of performance and jurisdiction for any disputes is the headquarters of EROL Medien GmbH.
9. Retention of title
The delivered goods remain our property until full payment.
